These terms and fees apply to all UK medico-legal instructions accepted by Professor Walsh unless otherwise agreed in writing.
TERMS
All medicolegal Consultations are undertaken via secure audio-visual telemedicine link.
Reports are provided within 6 weeks of Consultation, upon receipt of fee payment (including legal-aid funded cases).
Reports generated from documentation review without Consultation may take up to 6 weeks from the date of accepting Instructions.
For reasons of Governance and Data Protection, only electronic forms of clinical and medicolegal documentation are accepted.
FEES
Professor Walsh’s current hourly rate for medico-legal work is £400 per hour. This rate applies to:
• Review of medical records and documentation (See* below)
• Preparation of expert reports
• Meetings with solicitors and counsel
• Virtual meetings
• Review of documentation
• Preparation of supplemental reports
• Joint expert meetings
• Preparation for court attendance
Telephone consultation with client is charged at £400. Consultation non-attendance without 72h notification carries a £120 fee.
INITIAL REPORTS
For most cases, fees will be charged according to the time spent reviewing documentation, preparing and generating the Report. Upon receipt of records, an estimate of anticipated fees can be provided on request.
*Review of documentation/records up to 500 pages is charged within the £400 per hour rate stipulated above. Documentation/records will be charged at £2 per page beyond 500.
COURT ATTENDANCE
Agreement of date for court attendance: A non-refundable Booking Fee of £300 is applied.
Court attendance is charged at a fixed fee of £3,000 per day or £2000 per ½ day. Additional preparation time required before trial will be charged at £400 per hour.
CANCELLATION FEES
For court attendance:
• Cancellation more than 14 days before the hearing date – no charge.
• Cancellation between 7 and 14 days before the hearing date – 50% of the booked court attendance fee.
• Cancellation within 7 days of the hearing date – 100% of the booked court attendance fee.
Where preparation work has already been undertaken, this will remain chargeable, irrespective of cancellation.
TRAVEL
Travel time will be charged at £220 per hour. Reasonable travel expenses, accommodation costs, parking charges, and subsistence expenses will be charged in addition to professional fees.
INVOICING AND PAYMENT
Invoices will be issued upon report completion or court attendance.
Payment is due within 30 days of the Invoice date. Payments requiring telephone verification carry a 7.5% Admin surcharge. Invoiced payments outstanding at 30 days will be reissued with a 7.5% interest rate applied. Invoices remaining unpaid 30 days thereafter will be passed on to Medserv Medical Account Services with an additional 7.5% interest rate applied. These additional rates also apply to Legal Aid funded cases.
Non-electronic documentation can only be received by prior arrangement and agreement and incur a processing uplift charge of 7.5%. Non-electronic documentation received without agreement will not be processed and will incur a £50 disposal charge.
Professor Walsh reserves the right to suspend work on any matter where invoices remain unpaid beyond the agreed payment period.
VAT
All fees and expenses are exclusive of VAT where applicable. VAT will be added at the prevailing rate.
DOCUMENT RETENTION
Records and correspondence relating to instructions may be retained in accordance with professional and legal requirements. Files will be securely destroyed after an appropriate retention period.
ACCEPTANCE OF TERMS
Instruction of Professor Ian Walsh constitutes acceptance of these terms and conditions unless alternative arrangements have been agreed in writing prior to commencement of work.
